1. The applicant has preferred this first bail application under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 as he is in jail since 01.06.2026 in connection with Crime No. 40/2026 registered in Police Station- Bortalav, Dongargarh, District Rajnandgaon (CG) for commission of offence punishable under Sections 296, 109(1) & 3(5) of BNS and Sections 25 & 27 of Arms Act.

2. As per prosecution story, on 31.05.2026 at about 09:00 pm, complainant along with injured who is his nephew and other 04

persons cameback from Darrekasa, Maharashtra to their village Kotnapani by 03 motorcycles after attending Chatti ceremony. When they reached at Village Bortalav Forest Barrier, 02 unknown persons came from back side on a motorcycle abusing them filthy language and assaulted the injured namely Omprakash Chandrawanshi with an iron knife on the left side of his abdomen. The injured remained in hospitalized for 12 days. During investigation, the police arrested the present applicant and co-accused namely Karan Chandrawashi on 01.06.2026 and in their memorandum statements, they admitted that they have committed the offence. On such complaint, police registered the offences as stated above against the present applicant and co- accused Karan Chandrawashi.

3. Mr. Vijay K. Deshmukh, learned counsel appearing for the applicant would contend that stab injury was inflicted on the vital part of injured- Omprakash Chandrawanshi by the co-accused namely Karan Chandrawanshi. He would contend that the applicant was in company of that co-accused, therefore, he has falsely been implicated in the case. He would contend that the applicant has no criminal antecedent, he is languishing in jail since 01.06.2026 and charge-sheet has already been filed, therefore, he may be released on regular bail.

4. On the other hand, Mr. Dharmesh Shrivastava, learned Deputy Advocate General appearing for the State/non-applicant would oppose. He would submit that the present applicant along with co-accused- Karan Chandrawanshi assaulted the injured- Omprakash Chandrawanshi by means of iron knife. He would contend that the injury sustained by the injured was grievous in nature and he remained in hospitalized for 12 days, therefore, the bail application of the applicant deserves to be rejected.

5. I have heard learned counsel for the parties and perused the case diary.

6. Having considered the fact that allegation is against the co-accused- Karan Chandrawanshi who inflicted the knife blow on the left side of abdomen of the injured, the present applicant was travelling on the motorcycle of the co-accused, he has no criminal antecedent, he is in jail from 01.06.2026 and charge-sheet has already been filed, without commenting anything on merits of the case, I am inclined to grant bail to the applicant. Accordingly, the bail application is allowed.

7. It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned Trial Court, he shall be released on bail on the following conditions:- I. III. He shall appear before the trial Court on each and every date given to him by the said Court till the disposal of the trial; and,

IV. He shall not involve himself in any offence of a similar nature in future.

8. The observation made in the course of this order is only for considering the case of the applicant on the application for the grant of regular bail. The concerned trial Court shall not be influenced or bound by any observation made in the course of this order.
