1. Learned counsel appearing for the petitioners submits that the petitioners are aggrieved by the promotion order dated 26.12.2025, whereby the private respondents have been promoted to the post of Lecturer, alleging that despite being senior and eligible for consideration, the petitioners' cases were not considered by the Departmental Promotion Committee (DPC). It is further submitted that the petitioners' names appear above those of the private respondents in the gradation list dated 06.11.2024, prepared with reference to the position as on 01.04.2023, and that the petitioners had also submitted representations to the competent authority, which have not been acted upon.

2. Learned State counsel, referring to paragraph 10 of the reply filed on behalf of the State, submits that, upon receipt and verification of the relevant information from the District Education Officer, Raipur, it has been found that Petitioner No. 1 holds a postgraduate degree in Zoology and Petitioner No. 2 holds a postgraduate degree in Botany, which falls within the domain of Biology. It is further submitted that the cases of the petitioners shall be placed before the Departmental Promotion Committee in its next appropriate meeting for consideration in accordance with the applicable rules and guidelines.

3. It is also submitted on behalf of the State that the petitioners' cases were not considered earlier on account of the absence of requisite subject- related information in the records placed before the DPC and that the omission was attributable to administrative and procedural reasons. The State has expressed its commitment to ensuring consideration of the cases of all eligible candidates in accordance with the applicable rules. Learned State counsel further submits that the seniority/status of the private respondents in the writ petition will not be disturbed because of consideration of petitioners’ case by the Review DPC as the posts of Lecturer are still lying vacant.

4. In view of the stand taken by the State in paragraph 10 of its reply and the submissions made on its behalf, this Court is of the view that the grievance raised by the petitioners can be addressed by directing the State to undertake a fresh consideration of their cases through a review DPC with reference to the DPC held in the year 2025, pursuant to which the promotion order dated 26.12.2025 was issued.

5. Accordingly, without expressing any opinion on the merits of the petitioners' claim for promotion, the writ petitions are disposed of with the direction that the respondents shall convene a review Departmental Promotion Committee with reference to the DPC held in the year 2025, pursuant to which the promotion order dated 26.12.2025 was issued, for consideration of the cases of the petitioners for promotion to the post of Lecturer. The review DPC shall consider the cases of the petitioners in accordance with their eligibility, seniority, the applicable recruitment and promotion rules, and the relevant criteria governing promotion, taking into account the subject qualifications of the petitioners and the relevant records. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

6. Both the writ petitions stand disposed of in the above terms. SD/- SD/- (Bibhu Datta Guru)
