Order

on Board

(13.10.2026)

1. Heard on admission.

2. This appeal under Section 173 of the Motor Vehicles Act, 1988 has been preferred by the appellant/claimant challenging the award dated 29.06.2026 passed by learned Third Motor Accident Claims Tribunal, Raipur, District Raipur (CG) in Motor Accident Claim Case No.1083/2024, whereby the Tribunal has awarded a total compensation of Rs. 2,60,000/- on account of the injuries sustained by the Appellant in a motor vehicle accident that occurred on 10.04.2024.

3. The learned Tribunal, upon consideration of the evidence and documents available on record, held that the appellant had sustained grievous injuries, including a fracture of her right hand, in the accident. However, no evidence was found to establish that the appellant had suffered any permanent disability as a result of the injuries sustained. Accordingly, the learned Tribunal awarded compensation under the following heads: S.No. Compensation awarded by the Tribunal Amount

1. Loss of income for 03 months 75,000/-

2. Medical expenses Rs.60,000/-

3. Special diet and nutrition, transportation expenses and attendant Rs.25,000/- (lump sum)

4. Physical and mental pain Rs.1,00,000/- Total Rs.2,60,000/-

4. Learned counsel appearing on behalf of the appellant submits that the learned Claims Tribunal has erred in awarding a total compensation of Rs. 2,60,000/-, which is inadequate. He, therefore, submits that the compensation awarded by the learned Tribunal needs to be suitably enhanced.

5. Heard learned counsel for the appellant and perused the record with due care and circumspection.

6. In the case at hand, it is evident from the material available on record that the appellant sustained grievous injuries, including a fracture to her right hand, in the accident and underwent treatment at Global Star Hospital. However, no evidence has been adduced to establish that the appellant suffered any permanent disability as a result of the injuries sustained. Having regard to the nature and severity of the injuries and in absence of any evidence with regard to permanent disability, this Court is of the considered view that the compensation awarded by the learned Tribunal is just, fair, and reasonable and does not warrant any interference by this Court.

7. Consequently, finding no merit in the present appeal, the same is hereby dismissed at the admission stage.

8. No order as to costs. Sd/-
