Per

Narendra Kumar Vyas, J.

1. This petition has been filed by the petitioner for issuance of direction to the respondent police authorities to take lawful action on the written complaint dated 17.09.2026 submitted by him against respondent No. 7, alleging caste-based discrimination and commission of a cognizable offence.

2. The brief facts, as reflected from the record, are that the petitioner submitted a written complaint before the In-charge, Police Station AJAK, Rajnandgaon, alleging that he was posted as an Officer Class-I in Chhattisgarh Gramin Bank and during his tenure, his salary for the month of January 2026 was not paid until the last working day of the month and was subsequently disbursed in two installments on 25.02.2026 and 25.03.2026. It is further alleged that respondent No. 7 deliberately withheld the petitioner's salary with intention to harass him causing him financial loss, discriminated against him on the basis of caste, and failed to comply with the Officers and Employees Service Rules, 2013.

3. Considering the nature of the allegations made in the complaint and the relief sought by the petitioner, this Court is of the considered view that no direction, as prayed for, is warranted at this stage. The allegations relating to the alleged withholding of salary, the purported violation of the applicable service rules on the basis of alleged caste discrimination

cannot be a ground for this Court to issue direction to the Police Authorities to register the FIR as all the allegations made in the complaint require investigation which may take time for the investigating agency to enquire. In such a situation, any direction for registration of FIR is nothing but amounts to determination of the issue without proper investigation by the authorities.

4. In view of the above, no direction for registration of FIR can be issued by this Court at this stage. Accordingly, the petition sans merit is liable to be dismissed and it is hereby dismissed.

5. It is made clear that this Court has only recited the facts made in the complaint and no finding with regard to the allegation made in the complaint has been given by this Court. Sd/- (Narendra Kumar Vyas) Judge Sd/- (Sudhir Kumar) Judge Bhumika
