1. Learned counsel for the petitioner submits that the petitioner is working as a Sub-Engineer and was initially appointed on 24.08.2011 at the Project Implementation Unit, Balrampur, District Sarguja (C.G.). Thereafter, he was transferred from Balrampur to Korea and subsequently to Ambikapur. By order dated 30.09.2022, he was transferred from Ambikapur to the Panchayat and Rural Development Project Implementation Unit, Bilaspur (C.G.), where he has been working since then. By the impugned order dated 01.10.2026, the petitioner has again been transferred to the Project Implementation Unit, Ambikapur, District Sarguja (C.G.). Learned counsel also submits that the petitioner's wife, Smt. Archana Tandon, is suffering from a neurological disorder and is undergoing regular treatment at Apollo Hospital, Bilaspur. The petitioner further has two minor children studying in Classes II and III at Bilaspur. In view of the medical condition of his wife and the educational needs of his children, he seeks liberty to submit a representation before the competent authority for consideration of his grievances.
2. Per contra, learned State counsel opposes the submissions made on behalf of the petitioner. However, he submits that, if the petitioner submits a representation before the Committee constituted under Clause 8 of the State Transfer Policy, the same shall be considered and decided in accordance with law.
3. I have heard learned counsel for the parties and perused the documents available on record.
4. Considering the nature of the grievance raised by the petitioner and the submission made by learned State counsel, without expressing any opinion on the merits of the case, the petitioner is granted liberty to submit a fresh representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy within a period of 10 days from today. If such representation is submitted within the aforesaid period, the Transfer Committee shall consider and decide the same by passing a reasoned order, strictly in accordance with law and the applicable Transfer Policy, preferably within a period of 25 days from the date of submission of the representation.
5. With the aforesaid direction and liberty, the writ petition stands disposed of. Sd/- (BIBHU DATTA GURU)
