1) The applicant has preferred this first bail application under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 as he is in jail since 22.02.2026 in connection with Crime No. 95/2026 registered in Police Station – Akaltara, District Janjgir-Chama (CG) for commission of offence punishable under Sections 303(2), 112(2) & 3(5) of BNS.

2) As per case of prosecution, on 17.02.2026 complainant- Dushyant Kumar lodged an F.I.R. to the effect that his Eeco Car bearing registration No. CG-13-N-0999 which was lying stationary near his house at village Amlipali, Police Station Akaltara, was stolen in the intervening night of 16th-17th February, 2026. On such complaint, police registered an offence punishable under Section 303(2) of BNS against unknown person.

3) Learned counsel appearing for the applicant would argue that the applicant is innocent and he has falsely been implicated in the case. He would submit that charge-sheet has already been filed, the applicant is in jail from 22.02.2026 and the stolen Eeco Car was never seized from his possession. It is further argued that three criminal cases against the present applicant are pending before the competent Court. He would pray to allow instant bail application.

4) On the other hand, learned Panel Lawyer appearing for the State/non- applicant would submit that the Eeco car was stolen on 17.02.2026 and was subsequently used in the commission of offences punishable under Sections 126(2), 109, 309(6), 311, 61(2), 310, 111 and 238 of the BNS and Sections 25 and 27 of the Arms Act. She would submit that, on the same day, at about 09:15 p.m., the stolen vehicle was used in a robbery in which gold ornaments weighing approximately 2.200 kilograms, 350 grams of raw gold, 100 grams of fine gold and cash amounting to Rs.3,50,000/- were looted from Vivek Tiwari, who was engaged in the business of gold and silver ornaments. She would further submit that the stolen vehicle was seized from the place of the incident and during investigation, it was found to be the same vehicle that had been stolen on 17.02.2026. She would also submit that Vivek Tiwari was assaulted with the butt of a pistol and an iron rod, resulting in injuries. Lastly, she would submit that the applicant has three criminal antecedents and, therefore, the instant bail application may be rejected.

5) I have heard learned counsel for the parties and perused the case diary.

6) Having considered the submissions made by learned counsel for the parties, the facts and circumstances of the case, and the material available on record, it appears that the Eeco car bearing registration No. CG-13-N-0999 was stolen during the intervening night of 16th– 17th February, 2026. Subsequently, the present applicant was arrested in connection with the offences of attempt to murder and robbery, allegedly committed along with the other co-accused. Taking into consideration the nature of the allegations, the circumstances in which the stolen vehicle was allegedly used, and the c

7) riminal antecedents of the present applicant, I am not inclined to release the applicant on regular bail. Accordingly, the bail application is rejected.
