1. Learned counsel for the petitioner submits that the petitioner is working as a Sub-Engineer and is presently posted at Janpad Panchayat, Tilda, District Raipur (C.G.). He submits that the petitioner's wife, Monika Chandrakar, is also a Government servant, working as a Sub-Engineer (Civil), and has recently undergone surgery for an ectopic pregnancy. She is presently recovering from the surgery and requires rest, regular medical follow-up and family support. The petitioner has two minor children, aged about 5 and 8 years. Learned counsel further submits that, by the impugned order, the petitioner has been transferred to the Project Implementation Unit, Bilaspur (C.G.). In view of the medical condition of his wife, learned counsel prays that the petitioner may be permitted to submit a representation before the Committee constituted under Clause 8 of the State Transfer Policy, raising all the grievances pleaded in the writ petition, with a direction to the respondents to consider and decide the same.

2. Per contra, learned State counsel opposes the submissions made on behalf of the petitioner. However, he submits that, if the petitioner submits a representation before the Committee constituted under Clause 8 of the State Transfer Policy, the same shall be considered and decided in accordance with law.

3. I have heard learned counsel for the parties and perused the documents available on record.

4. Considering the nature of the grievance raised by the petitioner and the submission made by learned State counsel, without expressing any opinion on the merits of the case, the petitioner is granted liberty to submit a fresh representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy within a period of 10 days from today. If such representation is submitted within the aforesaid period, the Transfer Committee shall consider and decide the same by passing a reasoned order, strictly in accordance with law and the applicable Transfer Policy, preferably within a period of 25 days from the date of submission of the representation.

5. With the aforesaid direction and liberty, the writ petition stands disposed of. Sd/- (BIBHU DATTA GURU)
