1. Learned counsel for the petitioner submits that the petitioner is working as a Sub-Engineer in the Rural Engineering Services of the Panchayat and
Rural Development Department and is presently posted at Janpad Panchayat, Bhatapara, District Baloda Bazar (C.G.). By the impugned order dated 01.10.2026, the petitioner has been transferred to Janpad Panchayat, Bagicha, District Jashpur (C.G.), which is approximately 326 kilometres away from her present place of posting. Learned counsel further submits that the petitioner is a working woman and has a seven-year-old daughter studying in Class II, whose mid-term examinations have recently commenced. It is contended that the petitioner's husband is employed as a Senior Trackman in the South East Central Railway, Bilaspur Division, and that the petitioner has been discharging her official duties while also attending to her family responsibilities. Learned counsel submits that the impugned transfer would cause considerable hardship to the petitioner and adversely affect the care and education of her minor daughter. It is further submitted that the petitioner has already submitted a representation dated 05.10.2026 before the respondent authorities, seeking reconsideration of her transfer. Learned counsel, therefore, prays that the respondent authorities be directed to consider and decide the petitioner's representation.
2. Per contra, learned State counsel opposes the submissions made on behalf of the petitioner. However, he submits that, if the petitioner submits a representation before the Committee constituted under Clause 8 of the State Transfer Policy, the same shall be considered and decided in accordance with law.
3. I have heard learned counsel for the parties and perused the documents available on record.
4. Considering the nature of the grievance raised by the petitioner and the submission made by learned State counsel, without expressing any opinion on the merits of the case, the petitioner is granted liberty to submit a fresh representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy within a period of 10 days from today. If such representation is submitted within the aforesaid period, the Transfer Committee shall consider and decide the same by passing a reasoned order, strictly in accordance with law and the applicable Transfer Policy, preferably within a period of 25 days from the date of submission of the representation.
5. With the aforesaid direction and liberty, the writ petition stands disposed of. Sd/- (BIBHU DATTA GURU)
