1. By the present writ petition, the petitioner seeks a direction towards the respondent authorities to consider and decide his representation dated 03.06.2026 pending before the respondent No.2/ the Excise Commissioner, Raipur, C.G. seeking his transfer from District Surajpur or Sarguja, at his own expense.

2. Learned counsel appearing for the petitioner submits that the petitioner is presently working as Excise Head Constable at District Kabirdham. He submits that the petitioner has an ailing, widowed mother and three school-going children residing in District Surajpur and, considering his financial constraints, has submitted several representations since 26.12.2022 seeking transfer/attachment to District Surajpur or any other place within Sarguja Division at his own expense. He further submits that despite lapse of more than three-and-a-half years, no decision has been taken on the said representations, whereas several similarly situated employees have been transferred vide order dated 16.09.2026 (Annexure P/11). He, therefore, prays for a direction to the respondent authorities to consider and decide the petitioner's pending representations in accordance with law within a stipulated period.

3. Learned State counsel fairly submits that if the representation of the petitioner is still pending consideration, the same shall be considered and decided in accordance with law within the stipulated period.

4. I have heard learned counsel for the parties and perused the documents available on record.

5. Considering the nature of grievance raised by the petitioner and the submission made by learned State counsel, this writ petition is disposed of with a direction to the respondent No.2/ Excise Commissioner, Raipur, C.G. to consider and decide the petitioner’s pending representation dated 03.06.2026 (Annexure P/9) by passing a reasoned and speaking order, strictly in accordance with law, preferably within a period of 35 days from the date of receipt of a copy of this order.

6. With the aforesaid direction, the present writ petition stands disposed of. Sd/- (BIBHU DATTA GURU)
