1. The petitioner, in this Writ Petition, has prayed for the following reliefs:- “10.1 That this Hon’ble Court kindly be pleased to direct the respondent authorities for taking decision on claim U/s 80 of Act, 2013 10.2 Any other relief, which this Hon’ble Court may deem fit and proper, may also be passed in favour of the petitioner”

2. At the outset, learned counsel for respondent No.2/NHAI has raised an objection that the claim of the petitioner can very well be decided by availing the alternative remedy available under Section 3-G(5) of the National Highways Act, 1956, by filing an appropriate application before the competent authority.

3. At this stage, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to file an appropriate application under Section 3-G(5) of the National Highways Act, 1956, before the competent authority.

4. In view of the submissions made by learned counsel for the parties, the petitioner is permitted to withdraw the present writ petition with liberty to file an appropriate application before the competent authority within one month from the date of receipt of a copy of this order. Considering the fact that the matter has been pending before this Court since 2021, the competent authority is directed to consider and decide the application expeditiously, preferably within six months from the date of its filing, in accordance with law.

5. Accordingly, the present writ petition stands disposed of as withdrawn with the aforesaid liberty.
