1. By way of the present petition, the petitioner is challenging the impugned order dated 30.07.2025 (Annexure P/1), whereby Respondent No. 4, the Food Controller, District Raipur, suspended the license of the petitioner's Public Distribution Shop, namely, Manmohan Singh Bakshi Food Security, Nutrition and Consumer Services Cooperative Society Ltd., Raipur, bearing ID No. 441001325 (Khadya Suraksha, Poshan Evam Upbhokta Seva Sahakari Samiti Maryadit). The petitioner, therefore, seeks the following reliefs: “(i) That, this Hon'ble Court may kindly be pleased to call for the entire record concerning the case of the petitioner from the respondent authorities for its kind perusal.

(ii) That this Hon'ble Court may kindly be pleased to direct the respondent authorities to quash the order dated 30.07.2025 and permission to start title shop.

(iii) That this Hon'ble Court may kindly be pleased to direct a fresh inspection in the presence of all members of Society Shop.

(iv) Any other relief or relief(s) which this Hon'ble Court may deem fit or proper in any other writ direction or orders in favor of the petitioner and against the respondent upon this facts in the circumstances of the case in the interest of justice and in equity. . ”

2. Learned counsel for the petitioner submits that the license of

Government Fair Price Shop ID No. 441001325, managed by the petitioner, Manmohan Singh Bakshi Food Security, Nutrition and Consumer Services Cooperative Society Limited, was suspended, and the said fair price shop was temporarily attached, until further orders, to Government Fair Price Shop ID No. 441001353, operated by Saraswati Food Security, Nutrition and Consumer Services Cooperative Society Limited, on the ground that, as per the online inquiry, the stock available at the petitioner's fair price shop was found to be deficient. Learned counsel for the petitioner further submits that the impugned order was passed without affording the petitioner an opportunity of hearing and without assigning any cogent reason for suspending the fair price shop. Hence, the petitioner has challenged the impugned order before this Court.

3. Learned counsel appearing for the State submits that, under the Chhattisgarh Public Distribution System (Control) Order, 2016, upon suspension of a fair price shop, detailed proceedings are required to be initiated before the concerned Sub-Divisional Officer (Revenue), wherein the petitioner is afforded an opportunity of hearing. He further submits that a final order is required to be passed within 30 days. Accordingly, the petitioner's contention that the suspension was effected in violation of the principles of natural justice is not sustainable in law.

4. I have heard learned counsel for the parties and perused the material available on record.

5. Having considered the submissions advanced by learned counsel for the parties and the material available on record, this Court finds that the Chhattisgarh Public Distribution System (Control) Order, 2016, prescribes a procedure whereby the concerned Sub-Divisional Officer (Revenue) is required to initiate proceedings, afford the petitioner a reasonable opportunity of hearing, and thereafter pass an appropriate order in accordance with law within 30 days. Accordingly, the concerned authority is directed to initiate proceedings in accordance with the provisions of the aforesaid Control Order, afford due opportunity of hearing to the petitioner, and thereafter pass an appropriate order in accordance with law within the prescribed period. The petitioner shall be at liberty to appear before the concerned authority, participate in the proceedings, and adduce any evidence in support of his case. The concerned authority is directed to consider all the submissions and evidence adduced by the petitioner and pass an appropriate order in accordance with law within 50 days, as prescribed under the Control Order.

6. With the aforesaid observations, the instant writ petition is disposed of. Sd/- (Amitendra Kishore Prasad) Judge Chandrakant
