1. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for grant of regular bail, as she has been arrested in connection with Crime No. 518/2026, registered at Police Station Chakarbhatha, District Bilaspur (C.G.), for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, 1915.

2. The case of the prosecution, in brief, is that on 04.09.2026, the police party of Police Station Chakarbhatha, upon receiving secret information, intercepted the applicant and seized 45 bulk litres of illicit country-made liquor from her illegal possession. Thereupon, the aforesaid offence was registered against the applicant, and she was arrested and taken into custody on 04.09.2026.

3. Learned counsel appearing for the applicant submits that the applicant is an innocent female and has been falsely implicated in the present case. He further submits that the applicant has no criminal antecedents. She is languishing in jail since 04.09.2026, and being a woman, looking to the fact that the conclusion of the trial is likely to consume substantial time, she may be enlarged on regular bail.

4. On the other hand, learned State counsel opposes the bail application and submits that 45 bulk litres of country-made liquor was recovered from the possession of the applicant, therefore, she is not entitled to grant of regular bail. However, on instructions, the State counsel fairly admits that the applicant is a female and has no past criminal antecedents recorded against her.

5. I have heard learned counsel appearing for the respective parties and perused the case diary.

6. Taking into consideration the totality of the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and particularly noting that the applicant is a female, has no criminal antecedents, is in custody since 04.09.2026, and that the conclusion of the trial is likely to take some time, this Court, without commenting on the merits of the case, is inclined to release the applicant on regular bail. Accordingly, the regular bail application filed under Section 483 of the BNSS is allowed.

7. It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, she shall be released on bail, on following conditions :-

(i) she shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court,

(ii) she shall not act in any manner which will be prejudicial to fair and expeditious trial, and

(iii) she shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial.

8. The observation made hereinabove is for the purpose of deciding this bail application only, the trial Court shall decide the case on its own merits. Sd/-
