... Respondent(s) For Petitioner(s) : Mr. Pallav Mishra, Advocate. For Respondent(s)/State : Mr. Arham Siddiqui, Panel Lawyer. Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 09/10/2026

1. The present petition has been filed against the inaction of the respondent authorities in failing to upload the requisite details of four vehicles purchased by the petitioner through the online trading platform, MSTC Limited, from Respondent No 2. Although the petitioner completed the purchase on 18.04.2026 and 15.05.2026 and took delivery of the vehicles on 08.06.2026, the concerned Regional

Transport Office (RTO) has refused to transfer their registration in the petitioner's name until Respondent No. 2 uploads the requisite details on the online portal. Despite repeated requests, Respondent No. 2 has failed to do so, thereby preventing the petitioner from obtaining re- registration of the vehicles in his name. Being aggrieved by the inaction of the respondent authorities, the petitioner has filed the present petition seeking following reliefs :- “10.1 This Hon'ble Court may kindly be pleased to allow the petition filed by the petitioner; 10.2 That, the R-2 and R-3, DGP of Chhattisgarh and SP, Sarguja be directed to put the information of Vehicles mentioned as above in their official website so as to change of petitioner's name in the Office of Regional Transport Office; 10.3 To order the Cost of the Petition.”

2. Learned counsel for the petitioner submits that the inaction on the part of Respondent No. 2 is causing substantial financial loss to the petitioner, who, despite having purchased the vehicles at the highest auction price and paid the requisite consideration, is unable to use them due to the delay in transferring their registration. It is further submitted that the respondent authorities are under a legal obligation to facilitate the transfer of registration once the vehicles have been sold and the sale consideration has been received by the State. The delay is attributable solely to the respondents and not to the petitioner, who continues to suffer financial hardship despite having fulfilled all his obligations. Learned counsel further submits that maintaining an updated online portal reflecting the requisite details of the vehicles is the responsibility of the respondent authorities, which they have failed to discharge. The petitioner is also compelled to hire other vehicles for his personal and business requirements, thereby incurring additional expenditure. In support of his contention, learned counsel submits that the petitioner had earlier purchased a vehicle bearing Registration No. CG-02-8010 on 13.07.2026 from another State department, namely, the Chhattisgarh State Garage, whose details were duly reflected on its official website, and the vehicle was re-registered in the petitioner's name by the concerned Regional Transport Office without any delay. A copy of the purchase order has been filed as Annexure P/4. It is, therefore, contended that the failure of Respondent No. 2 to facilitate the registration of the vehicles, despite another department of the same State having completed the process without delay in a similar case, is arbitrary, discriminatory, and unsustainable in law.

3. Learned counsel for the petitioner further submits that the petitioner has also purchased two additional vehicles through auction on 25.05.2026, bearing Registration Nos. CG-03-6429 (Tata Sumo) and CG-03-6682 (Bolero). Accordingly, learned counsel submits that the concerned authorities may be directed to issue No Objection Certificates (NOCs) in respect of the aforesaid two vehicles as well, to facilitate the transfer of their registration in the petitioner's name. Accordingly, learned counsel for the petitioner prays that the present petition be allowed and appropriate directions be issued to the respondent authorities to facilitate the registration of the vehicles in the petitioner's name.

4. Learned Counsel appearing for the State submits that the concerned

Regional Transport Authority, vide letter dated 02.05.2026, has directed that the name of the petitioner, Vikram Advani, be recorded in the registration certificates of the government vehicles bearing Registration Nos. CG-03-5405 (Tata Sumo) and CG-03-5436 (Bolero), which were purchased by the petitioner through auction on 18.04.2026.

5. I have heard learned counsel for the parties and perused the material available on record.

6. Having considered the submissions advanced by learned counsel for the parties and the material available on record, this Court observes that, on the last date of hearing, learned State counsel was directed to seek instructions in the matter. Pursuant thereto, learned State counsel, upon instructions, submits that the concerned Regional Transport Authority, vide letter dated 02.05.2026, has directed that the name of the petitioner, Vikram Advani, be recorded in the registration certificates of the Government vehicles bearing Registration Nos. CG- 03-5405 (Tata Sumo) and CG-03-5436 (Bolero), which were purchased by the petitioner through auction on 18.04.2026. The aforesaid communication further indicates that the Superintendent of Police, Surguja, has issued a No Objection Certificate (NOC) for transferring the registration of the said vehicles in the name of the petitioner. In view of the aforesaid NOC issued by the Superintendent of Police, Surguja, the petitioner is directed to approach the concerned Regional Transport Office (RTO), Raipur, along with the relevant documents. Upon receipt of the petitioner's application, the RTO, Raipur, shall consider the same and take appropriate steps to record the petitioner's name in the registration certificates of the aforesaid vehicles, in accordance with law. It is clarified that the NOC issued by the

Superintendent of Police, Surguja, pertains only to the aforesaid two vehicles. The petitioner is directed to approach before the concerned authorities and get the NOC and thereafter to approach before the con cerned RTO for the other two vehicles.

7. With the aforesaid observations, the instant writ petition is disposed of. Sd/- (Amitendra Kishore Prasad) Judge Chandrakant
