1. This contempt petition has been filed by the petitioner alleging willful disobedience of the order dated 02.09.2024 passed by this Court in WP(227) No.244 of 2024 (Annexure C-1).
2. Perused the order which is stated to have been violated by the respondents herein.
3. Perusal of the order dated 02.09.2024 would show that there is an interim order staying further proceedings in Civil Suit No.A/ 55/2022 till the next date of hearing. However, there is no order directing the parties to maintain status quo with respect to any change in the nature of the suit property.
4. The only ground for filing of this contempt petition is that respondents are raising construction over the suit property.
5. In the aforementioned facts of the case, submission of learned counsel for the petitioner as also order dated 02.09.2024, violation of which is alleged for, I am of the opinion that this contempt petition is bereft of merit and the same is liable to be dismissed.
6. Accordingly, this contempt petition is dismissed. Sd/-- (Parth Prateem Sahu) Judge Praveen
