1. By way of this petition, the present petitioner has prayed for following reliefs:- “10.1 This this Hon'ble Court may kindly be pleased to issue appropriate writ/writs, order/orders, direction/directions directing Respondent No.5 Tahsildar, Raigarh, to conclude and finally decide the fresh demarcation proceeding arising out of the petitioner's application dated 07.08.2025, registered as Revenue Case 202509040100071/Year 2024-25, in accordance with law; 10.2 This Hon'ble Court may kindly be pleased to issue appropriate writ/writs, order/orders, Respondent direction/directions directing the Respondent No.5 Tahsildar, Raigarh, to conduct fresh demarcation of the petitioner's land bearing Khasra No. 321/1

खand Khasra No. 321/1

गsituated at Village Amlibhauna, Tehsil and District Raigarh, after giving due notice to the petitioner and all concerned/adjoining landowners and by following the prescribed procedure under Section 129 of the Chhattisgarh Land Revenue Code, 1959, 10.3 This Hon'ble Court may kindly be pleased to issue appropriate writ/writs, order/orders, direction/directions directing the Respondent No.5 to complete the entire demarcation proceeding and pass an appropriate final order within a stipulated period, and to furnish the petitioner a copy of the demarcation report, field book and map prepared pursuant thereto. 10.4 This Hon'ble Court be pleased to grant such other relief(s) in favour of the petitioner, as it may deem fit and proper in the interest of justice.”

2. Learned counsel for the petitioner submits that the petitioner is aggrieved by the demarcation proceedings and the order dated 19.12.2025 passed by the concerned Tehsildar in the said proceedings. It is submitted that the petitioner is, therefore, constrained to file the present petition seeking a direction to the concerned authority to carry out fresh demarcation of the petitioner's land in accordance with law.

3. Learned State counsel opposes the prayer, submitting that the demarcation proceedings were duly initiated and, thereafter, orders have been passed by the concerned SDO in appeal as well as by the Commissioner. It is submitted that, if the petitioner is aggrieved by the orders passed by the concerned authorities, he has to avail the appropriate remedy before the competent authority in accordance with law. The petitioner cannot seek a direction for fresh demarcation of the land without first assailing the orders already passed in the demarcation proceedings.

4. Heard learned counsel for the parties and perused the material available on record.

5. Considering the aforesaid facts and circumstances of the case, the present petition is disposed of with liberty to the petitioner to avail such appropriate remedy as may be available to him in law by assailing the orders passed by the Tehsildar, the SDO and the Additional Collector in the demarcation proceedings. It is made clear that this Court has not expressed any opinion on the merits of the case. Sd/-
