1. Applicant has preferred this application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of anticipatory bail as he apprehends his arrest in connection with Crime No. 331/2026 registered at Police Station- Gudiyari, District - Raipur (C.G.) for the offence punishable under Sections 296, 333, 115(2) and 351 (2) of BNS, 2023.

2. Case of prosecution, in brief, is that on 12.08.2026 at about 12:30 A.M. (in the midnight), the applicant entered into the house of the complainant (his in-laws house), knocked the door of his wife and thereafter, abused and assaulted her by means of steel pipe. When his sister-in-law and sister-in-law came to rescue their sister, he also assaulted them. In the said incident, all the three persons suffered injuries over their persons and the sister-in-law suffered one minor displaced fracture. The incident was report to the concerned police station in which, the applicant is apprehending his arrest.

3. Learned counsel for the applicant would submit that the applicant is innocent. He has been falsely implicated in the crime. He has not committed any offence as alleged. He submits that the complainant/wife is residing separately in her matrimonial home after leaving him since last 7-8 months due to which, the applicant came under frustration, in that frustration, he went to the house of his in-laws and at that time, the discussion aggravated in which, the incident took place. There was no intention to cause injury to his wife or his in-laws. There are no criminal antecedent registered against the applicant. Hence, he may be enlarged on bail.

4. On the other hand, learned State counsel opposes the submission of counsel for applicant and would submit that as per allegation, in the midnight the applicant entered into the house and have assaulted three persons including his wife. However, he do not dispute the relationship of the applicant with the complainant and the injured person.

5. I have heard learned counsel for the respective parties.

6. On due consideration of the facts and circumstances of the case, nature of allegation, submission of learned counsel for the parties, futher considering the relationship of the applicant with the complainant and the injured persons and further that, his wife (complainant) is residing in her matrimonial home since last 7-8 months with his two children, without commenting anything on merits, I am inclined to allow this anticipatory bail application.
