1. The present Cr.M.P. has been filed for restoration of Cr.M.P. No. 2153 of 2026, which was dismissed for non-compliance of the peremptory order dated 17.08.2026.

2. Vide order dated 17.08.2026, this Court, while referring the matter to the Mediation Centre of this Court, directed the petitioner No. 1 (husband) to deposit a sum of Rs. 50,000/- (Fifty Thousand) with the Mediation Centre of this Court within a period of one week from the date of the said order, and it was further directed that, on deposit, the same shall be paid to Respondent No. 2 (wife) on her appearance before the Mediation Centre.

3. Learned counsel for the petitioner submits that although he was present at the time of dictation of the order, but he missed out the part of the order to the effect that the order was peremptory in nature. Since the petitioner did not deposit the amount within the time stipulated in order dated 17.08.2026, the Cr.M.P. No. 2153/2026 was dismissed for non-compliance of the peremptory order. Learned counsel for the petitioner submits that due to a bona fide mistake of the learned counsel for the petitioner, the amount could not be deposited. Further, the said order was not reflected on the website of the Court. The petitioner only came to know about the said order when petitioner No. 1 appeared before the Mediation Centre of this Court.

4. Taking into note the submission made by learned counsel for the petitioners and the fact that the order dated 17.08.2026 was passed before the issuance of notice to Respondent No. 2 in Cr.M.P. No. 2153/2026, this Court feels that a further opportunity should be given to petitioner No. 1 (husband) to deposit the amount of Rs. 50,000/- before the Mediation Centre of this Court within a period of one week hence.

5. In view of the above, the present Cr.M.P. is disposed of with a direction that in the event the petitioner No. 1 deposits a sum of Rs. 50,000/- in terms of order dated 17.08.2026 before the Mediation Centre of this Court within one week hence, the Cr.M.P. No. 2153 of 2026 shall be restored to its original number and learned mediator shall act in accordance with the direction made in order dated 17.08.2026.

6. With the aforesaid direction, the present Cr.M.P. is disposed of. Sd/- Sd/- (Ravindra Kumar Agrawal) (Krushna Ram Mohapatra) Judge Chief Justice sagrika
