... Respondent(s) Order Sheet 30/09/2026 Shri Amitesh Yadav, Advocate for the petitioner. Shri Ayaz Naved, Advocate for the respondents. Heard. The present MCC has been filed seeking restoration of WPC No.3242 of 2016 which got dismissed for want of prosecution on 21.11.2023. Learned counsel for the petitioner would submit that due to unavoidable reason he could not appear before the court when the matter was called on for hearing and the case was dismissed for want of prosecution. He would further submit that the issue involved in the writ petition is cancellation of lease which requires adjudication on merits, and therefore, the said writ petition i.e. WPC No.3242 of 2016 may be restored to its original number and it be decided on merits. On the other hand, the counsel for the respondents opposes the submissions made by the counsel for the petitioners. Considering the submissions made by the counsel for the petitioner and also finding the reasons assigned to be genuine, the present MCC stands allowed and WPC No.3242 of 2016 is directed to be restored to its original number.
