1. The petitioner has prayed for the following reliefs: 10.1 That, this Hon’ble Court may kindly be pleased to set aside the order dated 22.11.2021 issued by the respondent no. 4 in favour of respondent no. 5 and further allowed the petitioner to continue the fair price shop at Kanjiya. 10.2 Any other relief which this Hon’ble Court deems fit and proper may also be passed in favour of the petitioner together with cost of the petition.
2. Learned counsel for the petitioner submits that the petitioner was allotted the fair price shop at Kanjiya by the competent authority vide order dated 01.12.2018. Thereafter, a show cause notice was issued to the petitioner on 09.05.2020 and the Sub-Divisional Officer suspended the petitioner's fair price shop licence vide order dated 11.05.2020. Being aggrieved by the said order, the petitioner preferred WPC No. 1739 of 2020, which came to be disposed of with a direction to the respondents to restore the position of the fair price shop in favour of the petitioner, with liberty to the respondents to proceed against the petitioner in accordance with law. It is submitted that, despite the aforesaid direction, no further proceeding has been initiated against the petitioner till date; however, the fair price shop earlier allotted to the petitioner has been allotted to respondent No. 5 vide order dated 22.11.2021.
3. Learned State Counsel opposes the submission made by the counsel for the petitioner.
4. Heard learned counsel for the parties and perused the documents available on record.
5. Considering the submissions made by learned counsel for the parties and without entering into the merits of the case, the respondents are directed to complete the proceedings in respect of the petitioner's fair price shop, strictly in accordance with the provisions of the applicable Control Order/Rules, 2016, after affording due opportunity of hearing to the petitioner as well as the other concerned parties, within a period of 30 days from the date of receipt of a copy of this order.
6. Accordingly, the present petition is disposed off. SD/-
