1. Learned counsel appearing for the petitioner submits that an amount of Rs. 86,989/-, being the compensation awarded in favour of the petitioner’s father, has not yet been disbursed. It is further submitted that the petitioner’s father expired on 17.07.2009 and despite the lapse of considerable time, the aforesaid amount of compensation has not been released in favour of the petitioner. In the aforesaid circumstances, the petitioner has approached this Court seeking the following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to compensate the petitioner the amount of Rs. 86,989/- with due interest from the date of acquiring the land. 10.2 That, this Hon’ble Court may kindly be pleased to pass an appropriate writ/direction against the respondent authorities to pay the compensation amount of Rs. 86,989/- with interest from the date of acquiring the land as per Gazette Notification in the said date”

2. Learned counsel appearing for respondent No. 2/SECL submits that the compensation amount has already been assessed and placed before the competent authority for disbursement. However, as the petitioner’s father did not approach the concerned authority, the compensation amount of Rs. 86,989/- has already been deposited before the Part-Time Tribunal-cum-District Judge, District Korba. It is, therefore, submitted that the petitioner may file an appropriate application before the concerned authority and seek release of the aforesaid amount in accordance with law.

3. Learned counsel appearing for the State also submits that since the compensation amount has already been deposited before the Part-Time Tribunal-cum-District Judge, District Korba (C.G.), the petitioner is required to file an appropriate application before the concerned authority for release of the said amount. It is further submitted that upon such application being made, the concerned authority shall take appropriate steps for disbursement of the compensation amount in accordance with law.

4. In view of the submissions advanced by learned counsel for the parties, the petitioner is directed to file an appropriate application before the Part-Time Tribunal-cum-District Judge, District Korba (C.G.), within a period of 30 days from the date of receipt of a copy of this order and in turn, the concerned District Judge shall verify the same and pass an appropriate order in accordance with law, for disbursement of the compensation amount after due verification of the relevant records. It is made clear that this Court has not expressed any opinion on the merits of the case.

5. With the aforesaid observations and directions, this writ petition stands disposed of. SD/-
