1. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has filed this OA praying for directing the Respondents to grant Dependent Pension (Special) to the applicant wef 07/5/1988 with interest @18% per annum. She has also prayed for award of cost of the OA as also any other relief, as applicable.

2. Vide Reply Statement, the Respondents have stated that Capt Narendra Kumar Sharma, son of the applicant was commissioned (PC) in the Army on 08/6/1985. The officer died on 06/5/1988 while in service in a motor vehicle accident and the casualty was considered as Physical Casualty and his death was considered as attributable to military service. He had rendered 2 years and 11 months of service. Consequent to demise of son of the applicant, the applicant was granted Dependent Pension wef 07/5/1988 for life, which was revised from time to time, apart from all other admissible benefits. Further, they have clarified that the Dependent Pension and Dependent Pension (Special) are the one and the same.

3. When the matter was taken up for hearing, in the absence of counsel for the Applicant, the Proxy Counsel sought adjournment of the matter as advised to her by the Counsel for the Applicant. However, it was stated by the Senior Panel Counsel appearing for the Respondents that as has been stated in the Reply statement filed by the Respondents, the grievance of the applicant has already been redressed by grant of Dependent Pension. Moreover, the parents are entitled to only dependent pension and not special family pension, which can only be given to the widow of a deceased service person. As the deceased was not married, the applicant who is the mother of the deceased person has already been granted dependent pension, wef 07/5/1988 as per Pension Regulations.

4. We have perused the material on record and the contention of the Senior Panel Counsel for the Respondents.

5. It is evident from the material on record that while in service, the son of the applicant met with an accident and died on 06/5/1988. Death of the son of the applicant was classified as physical casualty and the death was considered as attributable to military service. Accordingly, the applicant has been granted Dependent Pension wef 07/5/1988 for life, which has been revised from time to time. As nothing more can be granted, keeping the OA alive will not serve any purpose.

6. In view of the foregoing and since relief as admissible as per extant rules/policy has already been extended to the applicant on the unfortunate demise of her son, the OA is infructuous and the OA is dismissed accordingly.
