1. Under Section 14 of the Armed Forces Tribunal Act 2007, the applicant has filed this OA praying for grant of rounding off of his disability element to 50% wef 01/1/1996 for life to the applicant.

2. Perusal of record reveals that based on the Writ Petition No 606/2007 filed by the applicant before the Hon’ble High Court of Judicature for Rajasthan Bench at Jaipur which was transferred to this Tribunal and numbered as TA No 48/2009, this Tribunal vide Order dated 28/9/2011, partly granted Service Element of disability pension to the applicant wef 01/1/1973 onwards. This implies that the applicant was never granted disability element, but only service element for life. Therefore, the prayer of the applicant has no merit.

3. During the course of hearing, counsel for the applicant seeks permission to withdraw this OA with liberty to file de novo.

4. OA is dismissed as withdrawn with liberty as prayed for. File be consigned to record.
