A circular seal of the Armed Forces Tribunal. It features the scales of justice in the center, surrounded by the text "ARMED FORCES TRIBUNAL" in English and "सशस्त्र बल आदिलदुत" in Hindi. Below the scales, the word "ORDER" is written, followed by the date "22.04.2026".
1. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has filed this OA praying for directing the Respondents to adjust the pay scales of the applicant as per Option exercised by him and his pay be fixed at Rs 48,470/- as per Corrigendum PPO No M/Corr/007631/2012. He has also prayed that an amount of Rs 184,605/- deducted from the pension account of the applicant be refunded with 12% interest per annum alongwith suitable compensation for undue financial loss caused to the applicant by the Respondents for no reason.
2. With the passing away of designated counsel for the applicant, in response to the Notice dated 16/1/2026, issued to the applicant, the applicant has expressed his desire that he does not want to pursue the case any more.
3. Notwithstanding the above perusal of record reveals that vide Reply Statement, in response to the OA filed by the applicant, the Respondents have stated that pay of the applicant has already been stepped up to be at par with his juniors, viz, Col (TS) IS Thind and Col (TS) BK Jaiswal and arrears accruing out of this step has also been remitted to the applicant on 26/11/2019. Further, Corrigendum PPO has also been issued by the PCDA (P) and no further adjustments are required to be carried out.
4. In view of the foregoing and since the applicant himself has desired not to pursue the case anymore and the fact that prayer of the applicant has also been dealt with suitably by the Respondents by granting relief as per his entitlement, we deem it appropriate to dispose off this OA being infructuous.
5. OA is accordingly dismissed as infructuous. No order on costs.
6. Pending application, if any, also stands disposed off.
