1. Under Section 14 of the Armed Forces Tribunal Act 2007, the applicant has filed this OA praying for directing the Respondents to grant disability element of disability pension alongwith rounding off benefits wef 01/7/2001 for life to the applicant alongwith interest @18% per annum.

2. Vide Reply Statement filed by the Respondents, it has been stated that the applicant was enrolled in the Army on 16/8/1977 and was discharged from service wef 30/6/2001 on fulfilling the conditions of his enrolment under Rule13

(3) item III (i) of Army Rules, 1954. The RMB assessed the disability of the applicant, “Fracture Proximal Phalanx Great Toe (Lt) (Optd)” @1-5% for five years and considered it as attributable to military service as the injury sustained by the applicant while undergoing military training on 20/1/1995. He was not granted disability element of disability pension in terms of extant provisions on the subject.

The applicant had filed Civil WP No 5360/2006 before the Hon’ble High Court of Judicature of Rajasthan Bench at Jaipur, which was transferred to this Tribunal and numbered as TA No 163/2009. The TA was adjudicated by this Tribunal and vide Order dated 13/8/2014, prayer of the applicant for grant of disability element of disability pension was rejected as the disability of the applicant was assessed @ less than 20%.

3. We have heard the counsels for the parties and perused the material on record.

4. It is apparent from the material on record that the applicant had rendered 24 years and 13 days of service before being discharged from service wef 30/6/2001under Rule 13 (3) Item III (i) of Army Rules 1954. He was granted service pension for life for the qualifying service. The RMB assessed the disability of the applicant, “Fracture Proximal Phalanx Great Toe (Lt) (Optd)” @1-5% for five years and considered it as attributable to military service. Since the disability of the applicant was assessed @ less than 20%, he was not granted disability element of disability pension. Having been aggrieved by the denial of disability element, the applicant had filed Civil Writ Petition No 5360/2006 before the Hon’ble High Court of Judicature for Rajasthan Bench at Jaipur. The said Writ Petition was transferred to this Tribunal and numbered as TA No 163/2009. This Tribunal adjudicated the prayer of the applicant in the said TA threadbare and finding no merit therein dismissed the same vide Order dated 13/8/2014.

5. In view of the foregoing and since prayer of the applicant has already been dealt with by this Tribunal and rejected vide Order dated 13/8/2014,this matter is clearly Res Judicata and the OA filed by the applicant is a frivolous one and is not entertainable by this Tribunal. It is also prudent to observe that the applicant, vide Paragraph 7 of the OA, had unabashedly declared “that he had not previously filed any application, writ petition or suit regarding the matter in respect of which this application is made, before any court or any other authority or any other Bench of the Tribunal nor any such application, writ petition or suit is pending any of them”. The counsel for the applicant and the applicant are directed to be truthful while filing petitions in this Tribunal for redressal of their grievances.

6. In fine, the OA is dismissed having been rendered Res Judicata.

7. No order on costs.

8. Pending application, if any, also stands disposed off.
