1. During the course of arguments, Learned Counsel for the Applicant submits that the Respondents have filed a Writ Petition against the Order passed by this Tribunal before the Hon’ble High Court of Judicature for Rajasthan Bench at Jaipur and a stay on the implementation of the Order has been granted by the Hon’ble High Court. In view of this statement by the Counsel for the Applicant at Bar, the MA (E) is not maintainable as the implementation of the Order is stated to have been stayed by the Hon’ble High Court.
2. Accordingly, the MA (E) 17/2023 is disposed off with liberty to the Applicant to file afresh, if desired, on the outcome of the said Writ Petition.
3. File be consigned to records.
