1. **1. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has filed this OA praying for payment of interest for the period, from 18/11/2014 to 11/5/2020 for the delay involved in granting her Family Pension upon the demise of her beloved husband on 17/11/2014.**
2. During the course of hearing, Counsel for the Respondent PDA submits that the Respondent PDA had not defaulted in making the payment in time and payment to the applicant was made within nine days of the receipt of original PPO issued in her favour in May 2020 as earlier it was erroneously despatched to CPPC, Trivandrum, instead of sending to the CPPC, Jaipur. Based on their advice, a fresh PPO was issued in January 2021 and the payment was made to the Applicant in May 2022.
3. It has been observed that the applicant herein informed the PDA in 2018, four years after the demise of the original applicant seeking Family Pension in her favour. Thereafter, after receipt of requisite documents, the PPO was issued and a copy was sent to CPPC, Thiruvananthapuram, Kerala instead of CPPC, Jaipur.
4. In view of the foregoing and since the Respondent PDA was not at fault in not making the payment to the applicant in time, due to erroneous dispatch of PPO to SBI, CPPC, Thiruvananthapuram, Kerala, initially instead of to SBI, CPPC, Jaipur, Rajasthan, resulting in delay in disbursement of family pension to the applicant, in the interest of justice, we deem it appropriate to direct the Respondents to pay a cost of Rs 10,000/- (Rupees Ten Thousand only) to the Applicant within a period of one month from the date of receipt of a copy of this Order.
5. The OA is disposed off accordingly. No order on costs.
6. Pending application, if any, also stands disposed off.
