1. By way of this Application under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has prayed for directing the Respondents to pay compound interest @ 18% on the amount of Rs. 2,90,000/- withheld by the Respondents illegally for a period of two years and four months.

2. We have heard Learned Counsel for both the parties and perused the material placed before us.

3. Perusal of the records reveals that the Disability Pension of the Applicant was initially disbursed through Treasury Office, Nagaur (Raj) through PPO No D/414/2005, with Service Element of Disability Pension for life and Disability Pension wef 01.01.1996 till next RSMB. Thereafter, the Applicant’s Disability was assessed @ 30% for life and he was granted Disability Element of Disability

OA No 291/2023 Ex Sep Chhatoo Singh Vs UOI & Ors Pension for life wef 01.01.1996 vide PPO No D/RA/1480/2006 dt 24.04.2006. Based on the Application dt 06.11.2006 submitted by the Applicant, his Pension account was transferred from Treasury Office, Nagaur (Raj) to State Bank of Bikaner and Jaipur (SBBJ), now State Bank of India (SBI), Maroth, Nagaur (Raj). At the time of transfer of pension documents, SBI Nagaur did not receive copy of latest PPO dt 24.04.2006 wherein his disability element of pension was granted for life wef 01.01.2006. However, the Respondent PDA continued to grant him Disability Element of Disability Pension which, on being noticed, was discontinued wef 01.03.2020 and effected recovery of overpayment for the period from 01.01.2006 to 29.02.2020 by way of equated monthly instalments of Rs. 6048/- pm wef 01.03.2020. Thereafter, on receipt of a copy of PPO dt 24.04.2006, the Respondent PDA (R-4) issued Loss Certificate on 16.02.2022. Immediately on issuance of Loss Certificate for the PPO dt 24.04.2006, the Applicant has been paid the arrears of Disability Element of Disability Pension wef 01.01.2006 alongwith the amount recovered from the Applicant. The amount along with the arrears of Disability Element of Disability Pension refunded to the Applicant has also been reflected in the copy of Bank Pass Book placed on record by the Applicant. Moreover, at the time of issuance of PPO dt 24.04.2006, the pension account of the Applicant was being maintained by Treasury Office, Nagaur and the copy of PPO dt 24.04.2006 was not supplied to SBI, Maroth, Nagaur (Rajasthan) by Treasury Office, Nagaur (Rajasthan) at the time of transfer of his pension account to SBI, Maroth, Nagaur (Rajasthan). Therefore, the Respondent PDA (R-4) cannot be held responsible for that.

4. Taking note of overall facts and circumstances of the case and also the fact thatthe recovered amount as also full arrears have already been credited to the Applicant’s account, we see no reason and grounds to grant compound interest to the Applicant and the OA is dismissed as infructuous. Pending Miscellaneous Application (s), if any, also stand disposed off.

5. No order on costs.
