1. 1. Under Section 14 of the Armed Forces Tribunal Act 2007, the applicant has filed this OA praying for directing the Respondents to revise the Reservist Pension of the applicant from the date the same has fallen below 2/3rd of a Sepoy with 15 years of service after 01/1/2006 and revise the pension from Rs 9000/- to Rs 11,419/- wef 01/7/2014 and again from Rs 11,419/- to Rs 12,538/- wef 01/7/2019 as per the provisions laid down in Regulation 155 of the Pension Regulations for the Army 1961, Part I by giving him the benefit of OROP I and OROP II.

1. 2. Vide Reply Statement, the Respondents have submitted that the applicant was enrolled in the Army on 13/9/1960 and was discharged from service wef 30/9/1975 under the provisions of Rule 13 (3) Item III (i) of Army Rules, 1954 after rendering 15 years and 18 days of service for which he was granted Reservist Pension for life, which was revised from time to time. Asa per Govt of India, Ministry of Defence letter dated 29/10/2016, the revised rate of Reservist Pension has been fixed @Rs 9,000/- pm plus DA as admissible, wef 01/1/2016. Further, it has also been clarified that as per Circular No 501 dated 17/1/2013 and Circular No 555 (OROP) dated 04/2/2016, further revision as per OROP are not applicable to Reservist Pensioners. IHQ of MoD (Army) has taken up a case with the Ministry of Defence for inclusion of Reservist Pension in the One Rank One Pension Scheme and has since issued directions to wait for further orders on it.

2. 3. In view of the submissions made by the Respondents, it is evident that since the applicant is a Reservist Pensioner, he is not eligible for revision of his Pension wef 01/7/2014, wef 01/1/2016 based on revision wef 01/7/2014 under OROP I and wef 01/7/2019 under OROP II. However, he is eligible for revision wef 01/1/2016 which has already been done by the Respondents.

3. 4. During the course of hearing, Counsel for the Respondents submits that a similar issue regarding revision of Reservist Pension is pending adjudication before the Hon'ble Apex Court in the case of UOI Vs Ex Sep (Reservist) Darshan Singh Bal & Anr, wherein a stay on implementation of Orders of various AFTs/Hon'ble High Court of Punjab and Haryana has been ordered till the disposal of the case.

4. 5. In view of this fact, this application at this stage is not maintainable. The prayer of the applicant shall be considered based on the final outcome of Petition/Appeal pending before the Hon'ble Apex Court by the Competent Authority. There is no gainsaying the fact that the Applicant shall also be at liberty to approach this Tribunal de novo, once the judgment is passed by the Hon'ble Apex Court, if so desired. Counsel for the applicant has raised no objection in this regard.

1. 6. The Application is disposed off accordingly. File be consigned to record.

2. 7. Pending application, if any, also stands disposed off.
