additional quantum @20% on completion of 79 years with effect from 13/9/2021 and pay the arrears with all consequential benefits with interest @ 9% pa.

3. The Respondents have filed a detailed Reply Statement. They have submitted that the applicant was enrolled in the Army on 13/9/1960 for a contractual period of 15 years, ie, 7 years color and 8 years reserve service, and was discharged from service wef 30/9/1975 under the provisions of Rule 13 (3) Item III (i) of Army Rules after rendering 15 years and 18 days of service. He was granted Reservist Pension for life, which was revised from time to time. With regard to the plea of the applicant for grant of additional pension on attaining the age of 79 years, for which a legal notice was served upon the Respondents, which was replied to suitably to the effect that the applicant was advised to approach the PDA concerned for the same, vide Record Office letter dated 06/9/2023. Further, as per the service record of the applicant, his date of birth is 13/9/1942 and, therefore, the applicant is eligible for 20% additional pension on completion of 80 years of age wef 01/9/2022 and not wef 13/9/2021 on completion of 79 years, as has been stated by the applicant, in terms of Circular No 165 dated 22/2/2013. Accordingly, the applicant has been granted 20% additional quantum of pension wef 01/9/2022, ie, the first day of the month in which he attained the age of 80 years.

4. We have heard the counsels for the parties and perused the material on record.

5. It is evident from the material on record that the applicant was a Reservist Pensioner, granted Reservist Pension wef 01/10/1975 for life. Based on the Date of the applicant as 13/9/1942, the applicant had already been granted additional Pension @20% as admissible as per extant rules/policy on the subject wef 01/9/2022, on completion of 80 years of age.

6. In view of the foregoing and since relief has already been extended to the applicant on his attaining the age of 80 years wef 01/9/2022, this OA has become infructuous and the OA is accordingly dismissed as infructuous.

7. The OA is disposed off accordingly. No order on costs.
