24.03.2026**

1. This MA Execution application has been filed by the counsel for the applicant for execution of Order dated 28/8/2023 passed in OA No 290/2016 by this Tribunal. Vide Order ibid, this Tribunal had directed the Respondents to conduct a fresh RAMB of the applicant to ascertain his present degree of disability for the disability, "Crush Injury (Rt) Foot", which he had sustained way back in 1997 while on his way to Kota Railway Station, when he was hit by a Scooter. The applicant was eventually discharged from service in SHAPE-1 after being in low medical category for a limited period in the year 2003.

2. During the course of hearing, Counsel for the Respondents submits that the DB Civil Writ Petition No 837/2025 filed by the Respondents in the case of UOI & Ors Vs Ex Hony Sub Maj Mahender Singh, before the Hon'ble High Court of Judicature for Rajasthan Bench at Jaipur against the Order dated 28/8/2023 passed by this Tribunal has been allowed by the Hon'ble High Court vide its Order dated 16/3/2026 quashing and setting aside the said Order of this Tribunal. In support of their contention, counsel for the Respondents has placed on record a copy of the ibid Order of the Hon'ble High Court, which is taken on record.

3. In view of the foregoing and since Order dated 28/8/2023 passed in OA No 290/2016 filed by the applicant has been quashed and set aside by the Hon'ble High Court, this Execution Application is not maintainable and accordingly, this MA Execution Application is dismissed.
