1. During the course of hearing, Counsel for the Respondents submits that in pursuance to the DB Civil Writ Petition No 17430/2024 filed by them before the Hon’ble High Court of Judicature for Rajasthan Bench at Jaipur in the case of UOI & Ors Vs Ex Naik Mukesh Kumar, against the Order passed by this Tribunal, a stay has been granted by the Hon’ble High Court vide its Order dated 02/12/2024 against execution of Order passed by this Tribunal. A copy of ibid Order has been placed on record by the Respondents, which is taken on record.
2. In view of this fact, at this stage the MA Execution is not maintainable. However, the applicant shall be at liberty to file fresh execution application consequent to the final decision of the said DB Civil Writ Petition by the Hon’ble High Court, if so desired.
3. The Application is disposed off accordingly. File be consigned to record.
