After hearing Learned Counsel for both sides, the following issues are framed in agreement of the Counsel:-
1. Whether the Petitioner is entitled for recovery of 4194 Set-Top Boxes (STBs) and viewing cards from the Respondent in good working condition or, in the alternative, to receive an amount of Rs.52,42,500/- (Rupees Fifty Two Lakh Forty Two Thousand Five Hundred Only) towards the cost of the STBs i.e., @ Rs.1250/- per STB?
2. Whether the Respondent have illegally migrated to competing MSO in violation of Interconnect Regulations and also in violation of the terms of the agreement between the parties?
As prayed for, let the Evidence Affidavit be filed by the Petitioner within four weeks from today.
