1. 1. The Applicant has filed this MA praying for condonation of delay of one year and four months involved in filing the OA. Delay is condoned.

**OA No 99/2024**

1. 2. Under Section 14 of the Armed Forces Tribunal Act 2007, the applicant has filed this OA praying for directing the Respondents to step up the pay of the applicant from Rs 46,200/- to Rs 47,600/- also also grant pension @Rs 26,400/- instead of Rs 25,700/- wef 01/5/2022 and further grant Gratuity @Rs 10,96,656/- instead of Rs 10,43,677/- already granted to him and other retiral benefits such as Leave Encashment by taking correct rates of pay at the time of his discharge from service and the arrears be paid with interest @12% per annum. He has also prayed for award of suitable compensation to the applicant for the undue financial loss caused to him by the Respondents for no reason.

3. While the Respondents have not filed a Reply Statement in this matter, counsel for the applicant during the course of hearing, made a categorical statement that pension of the applicant has since been revised in accordance with his entitlements as prayed for and arrears accruing thereof had already been paid to the applicant. However, arrears on account of enhanced pay, leave encashment and Gratuity due to stepping up of his pay have so far not been paid to the applicant in accordance with the prevailing rules. Counsel for the Respondents submitted that he has not yet received any such instructions.

However, in view of the above assertion of the counsel for the applicant, the OA is disposed off with a direction to the Respondents to take necessary steps with regard to payment of difference in amounts as per his entitlements due to enhanced pay with effect from the date admissible within a period of six months from the date of receipt of a copy of this Order, failing which, the applicant shall be entitled to receive interest @6% per annum on arrears so worked out till the date of its actual payment.

5. The OA is disposed off accordingly. No order on costs.

6. Pending application, if any, also stands disposed off.
