02.02.2026

1. By way of this Application under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has prayed for directing the Respondents to allow the Applicants to continue in service till attainment of age of 55 years in pursuance of letter dt 05.01.1996 and TA Act of 1948 and TA Rules and Regulations.

2. During the course of arguments, Learned Counsel for the Respondents submits that since the Applicants have already been discharged from Service in accordance with the policy, the OAs have become infructuous. However, if they want to get Discharge Certificates for the service rendered in TA (Eco), the same shall be provided to them, if the Hon’ble Tribunal pass Order to the Respondents. Proxy Counsel for the Applicant raised no objection to the statement made at Bar by the Learned Counsel for the Respondents.

3. In view of the above, we direct the Respondents to issue Discharge Certificates to the Applicants within a period of two months from the date of receipt of a certified copy of this Order in terms of extant rules/regulations and policies governing service rendered by military personnel in TA Eco Task Forces.

4. The OAs are disposed off accordingly. Pending Miscellaneous Application(s), if any, also stand disposed off.
