Record perused. On the last date of hearing, Proxy Counsel Sh. Sachin on behalf of the claimant had appeared and moved an application seeking withdrawal of the present case. Since no affidavit of the claimant has been annexed with the application, this court has asked the proxy counsel either to file the affidavit of the claimant or produce the claimant for recording his statement. However, neither claimant nor his counsel has appeared today.

Considering the above circumstances, it appears that claimant is not interested in pursuing his claim, this Tribunal has no other option but to dismiss his claim. Hence, his claim stands dismissed. Award is passed accordingly. A copy of this award is sent to the appropriate government for notification as required under section 17 of the ID act 1947. File is consigned to record room.
