**ORDER

06.03.2026**

1. 1. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has filed this OA praying for directing the Respondents to stop recovery of commutation value and refund the excess amount recovered over and above the commutation value after 15 years from the date of discharge of the applicant. He has also prayed for directing the Respondents to refund the amount with interest @12% as also costs of litigation.

2. 2. When the matter was taken up for hearing today, Counsel for the Applicant submits that during the pendency of the OA, the grievance of the Applicant has been redressed by the Respondents by refunding the excess commuted value of pension recovered beyond the mandated period of 15 years from the date of discharge of the applicant and, hence, nothing remains on the part of the Respondents.

3. 3. In view of the grievance of the applicant having been redressed during the pendency of the OA, as has been categorically stated by the counsel for the applicant at the Bar, this OA has become infructuous and the OA is dismissed as infructuous.

4. 4. File be consigned to record.
