1. During the course of hearing, Senior Panel Counsel appearing for the Respondents undertakes that Order dated 16/1/2012 passed by this Tribunal, wherein Respondents were directed to grant disability element of disability pension @30% alongwith rounding off benefit to 50% wef 01/1/1996 shall be extended to the applicant within a period of 14 weeks in terms of Govt of India, Ministry of Defence letter No 12(16)/2009/D)Pen/Policy) dated 15/9/2014, as the applicant herein was invalided out from service. It is made clear that in case compliance is not done within the timeline stated herein, the applicant shall be entitled to receive a cost of Rs 5,000/- (Rupees Five Thousand only) from the Respondents for non compliance.
2. In view of the foregoing, this Execution Application is disposed off accordingly. File be consigned to record.
