1. 1. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has filed this OA praying therein to direct the Respondents to grant correct Basic Pension to the Applicant wef 01.07.2024 as per OROP Scales and that the arrears be paid along with interest @ 12% per annum.

2. 2. The brief facts of the case as enunciated by the Applicant are that he, after rendering 17 years, 9 months and 14 days of service, was discharged from Service in the rank of Havildar on 31.12.1999 for which he has been granted Service Pension. The Applicant has been granted correct scale of Basic Pension as per his entitlements. The Applicant's pension account has been transferred to PCDA (SPARSH) in the year 2023. On revision of Service Pension to OROP scale wef 01.07.2024, the Applicant's Basic Pension has been fixed @ 21,782/- pm instead of Rs. 22,994/- pm. The Applicant made representation as also issued Legal Notice for revision of Basic Pension as per OROP Scales wef 01.07.2024, but to no avail. Therefore, the aggrieved Applicant has filed present OA.

3. The Respondents have filed a detailed Reply Statement and while not disputing the basic facts presented by the Applicant, the Respondents have submitted that on implementation of OROP-III, the Applicant's Basic Pension has been revised to Rs. 23,432/- pm wef 01.07.2024 in terms of Govt of India, Ministry of Defence letter No 1(2)/2023/D(Pen/Pol) dt 04.09.2024. In support of their claim, the Respondents have placed on record copies of PCDA (P) Corr No 3 of PPO No 226199900759 dt 21.09.2024 and Applicant's Pension Slip for the month of Jun 2025. In view of the aforesaid facts, the Respondents have reiterated that the Applicant is getting correct Basic Pension wef 01.07.2024 as per OROP-III Scale and, hence, the OA is devoid of merit and deserves to be dismissed.

4. We have heard Counsels for both the parties and perused the material placed on record.

5. In the present case, the Applicant has rendered 17 years, 9 months and 14 days of service and, accordingly, the Applicant's Service Pension in the rank of Havildar has been taken as 18 years after applying rounding off benefit of Service. As per Table No 7 of Govt of India ibid letter dt 04.09.2024, Basic Pension of a Havildar with 18 years of service has been fixed @ Rs. 23,432/- pm. Perusal of Corr No 3 of PPO No 226199900759 dt 21.09.2024 reflects that the Basic Pension of the Applicant has been correctly revised to Rs. 23,432/- pm wef 01.07.2024. Further, as per Pension Slip for the month of Jun 2025, the Applicant is also getting Basic Pension @ Rs. 23,432/- pm. From the above, it is crystal clear that on implementation of OROP-III, the Applicant's Basic Pension has correctly been fixed to Rs. 23,432/- pm as per his entitlements which the Applicant is also getting.

---

6. In view of the aforesaid facts, the prayer of the Applicant for revision of his Basic Pension as per OROP Scale wef 01.07.2024 lacks merit and, hence, is dismissed. Pending Miscellaneous Application(s), if any, also stand disposed off.

7. It has also been seen that since the Applicant's pension has been revised to Rs. 23,432/- pm wef 01.07.2024, as per OROP-III revision, it is more than what the Applicant is seeking viz., Rs. 22,994/- pm. His pension was revised to Rs. 21,782/- pm wef 01.07.2019 and Rs. 23,432/- pm wef 01.07.2024 as is shown in the relevant PPOs placed on record. This is a clear case of vexatious litigation and has wasted precious time of this Tribunal and all concerned and, accordingly, the OA is dismissed with a token cost of Rs. 100/- only.
