13.03.2026
1. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has filed this OA praying for quashing and setting aside the Discharge Book (Non Ex- Servicemen) issued in respect of the applicant vide DSC Kannur dated 12/5/2023, vide which the status of Ex-Serviceman has been erroneously denied to the applicant. He has further prayed for directing the Respondents to grant ‘Ex- Serviceman’ Status to the applicant with effect from the date of his discharge from DSC service, ie, wef 31/5/2023 and to issue a fresh Discharge Book duly endorsed as ‘Ex-Serviceman’ and that extend all consequential benefits, privileges
2
and entitlements admissible to an ex-serviceman applicant as well as his dependents with effect from the same date.
2. With the consent of both the parties, we deem it appropriate to dispose off this OA at the admission stage itself.
3. Perusal of material placed on record reveals that the applicant was enrolled in the Army on 22/3/2007 and was discharged from service on 31/5/2023 after rendering more than 16 years service and was granted service pension for the qualifying service. However, on the first page of the Discharge Book issued to the Applicant, Annexure A/2, the status of the applicant has been endorsed as, “Non-Ex Serviceman”.
4. During the course of hearing, Senior Panel Counsel appearing for the Respondents submits that the applicant is a pensioner and the endorsement made on the first page of the Discharge Book issued to the applicant was erroneous and the same shall be corrected expeditiously as per the statutory provisions and rules in this matter.
5. With the categorical statement of the Senior Panel Counsel at the Bar, this OA is allowed and the Respondents are directed to do the needful in this matter expeditiously, but not later than eight weeks from the date of receipt of a copy of this Order.
6. The OA is disposed off accordingly. No order on costs.
7. Pending application is also disposed off accordingly.
