1. Under Section 14 of the Armed Forces Tribunal Act 2007, the applicant has filed this OA praying for directing the Respondents to correctly fix the Pay Band of the applicant @Rs 40,400/- at par with other similarly placed personnel, by implementing the applicant’s Option for Fixation of Pay for the period from 2016 to 2026 and thereafter, to recompute and release the arrears of pay flowing from correct fixation of Pay Band together with interest at such rate as this Hon’ble Tribunal may deem it. He has also further prayed for giving direction to re-fix and revise the service pension of the applicant consequent upon correct fixation of his Pay Band wef the date of his discharge, ie, 30/4/2026 and release the arrears of pension so arising with interest.

2. During the course of arguments, counsel for the applicant seeks permission to withdraw this OA with permission to file Representation before the Competent Authority for the relief sought for in the OA. Prayer is allowed.

3. In view of the prayer of the applicant, if the applicant submits a Representation with regard to the prayer of the applicant within a period of one month from the date of receipt of a copy of this Order, it is expected that the Competent Authority shall decide the issue on its merits as per the rules and regulations on the subject within a period of six months from the date of receipt of such a Representation from the Applicant.

4. With the above observations, the OA is disposed off. No order on costs.
