1. During the course of hearing, Proxy Counsel for the Respondent – Applicant in the OA – sought adjournment on the Review Application filed by the UOI, praying for review of Order dated 28/8/2023 passed by this Tribunal. Review Application was filed on the ground that the applicant was discharged from service at his own request and was not superannuated

2. Perusal of record reveals that vide Order dated 28/8/2023 in OA No 167/2021, the Respondents were directed to grant one notional increment one day after the date of retirement of the applicant in terms of judgment passed by the Hon’ble Apex Court in this regard subject to verification of qualifying service rendered by the applicant therein.

3. Apart from a delay of two years, four months and two days in filing the Review Application, we do not find any error apparent on the face of record, warranting review of the Order passed in merit and based on the judgment of the Hon’ble Apex Court.

4. RA is dismissed accordingly. MA No 44/2026 filed for condonation of delay involved in filing the RA also stands disposed off.

5. Further, we grant six weeks’ time to the Respondents to comply with the Order dated 28/8/2023 after verifying the qualifying service rendered by the applicant. The Respondents are also directed to inform the applicant if he is not eligible for the benefit of one notional increment through a Speaking Order.

6. The file be consigned to record.
