1. During the course of hearing, Senior Panel Counsel appearing for Respondents submits that compliance in pursuance of the Order passed by this Tribunal has been done in this matter and nothing remains on their part. In support of his arguments, Senior Panel Counsel has placed on record a copy of the letter dated 03/10/2025 issued by the Office of the PCDA (P), Prayagraj, showing the details of amount admissible and paid to the applicant, which is taken on record. Contra, counsel for the applicant submits that vide the ibid letter, an interest amount of Rs 17,021/- has purportedly been paid to the applicant in excess to his entitlement and, hence, is recoverable from the applicant, which is against the spirit of letter dated 01/4/2024, issued by the Govt of India, Ministry of Finance, Department of Expenditure, a copy of which has also been placed on record by the counsel for the applicant.

2. In view of the compliance having been done in this matter as has been stated in the letter dated 03/10/2025 of the PCDA (P), this application has become infructuous and the file be consigned to record. However, with regard to recovery of excess interest amount of Rs 17,021/- paid to the applicant, it is seen that the said letter dated 01/4/2024 (supra) pertains to excess payment made to Govt servants, whereas in the instant case, the proposed recovery is on account of interest payment made in excess of the entitlement on the arrears paid on account of pension on the orders of the AFT, and hence, this OM is not applicable in this case. Accordingly, the Respondents shall take note of the contention made by the counsel for the applicant about the applicability of Govt of India, Ministry of Finance letter dated 01/4/2024 in this regard.
