1. Under Section 14 of the Armed Forces Tribunal Act 2007, the applicant has filed this OA praying for directing the Respondents to restrain from recovering the amount of excess pension paid to the applicant to the tune of Rs 1,94,941/-. He has also prayed for directing the Respondents to refund the amount recovered already from the pension account of the applicant with 12% interest.

2. We have heard the counsels for the parties and perused the material placed on record.

3. Perusal of record reveals that a sum of Rs 1,94,914/- has been paid to the applicant in excess to his legitimate dues by the then State Bank of Bikaner and Jaipur (Now State Bank of India), which was contrary to the rule of the Govt of India, Ministry of Personnel, Public Grievances & Pensions, Department of Personnel and Training letter dated 06/2/2014 and letter of even No dated 02/3/2016. The details of excess amount paid to the applicant were also communicated to the applicant by the PDA, Annexure A/2. The excess amount paid to the applicant was detected when the applicant made a representation to

the PCDA (P) about his query about his entitlement of pension wherein his actual entitlements were tabulated and the PSA detected the erroneously paid excess amount which was conveyed to the PDA by the PCDA (P) vide their letter dated 20/5/2016 with a copy to the applicant. This Tribunal Vide Order dated 01/3/2017, has granted interim stay on recovery effected from the pension account of the applicant.

4. It is not in dispute that there are certain directions with regard to recovery from the pension of the soldiers. In view of this fact, the counsel for the applicant prays for permission to withdraw this OA with liberty to file a fresh representation to the competent authority for his grievance prayed for in the OA.

5. The OA is, therefore, dismissed as withdrawn with liberty as prayed for.

6. In view of the withdrawal of this OA, the interim stay granted by this Tribunal vide Order dated 01/3/2017, has been rendered null and void.

7. OA is disposed off accordingly. No order on costs.

8. Pending application, if any, also stands disposed off.
