1. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) seeking quashing of FIR No. 789/2023 dated 3rd December, 2023, registered at P.S. Bindapur, Delhi, under Sections 420/34 of the Indian Penal Code, 1860 (‘IPC’) and all proceedings arising therefrom, on the ground of settlement.

2. Issue notice.

3. Notice is accepted by the APP appearing on behalf of the State and the counsel appearing on behalf of the respondent no. 2 to 4.

4. Disputes arose between petitioner and respondents no. 2 to 4, with respect to sale of a property allegedly misrepresenting material facts and inducing the respondents into a fraudulent transaction, which resulted in the filing of the present FIR.

5. Now, the parties have settled their disputes in terms of the Memorandum of Understanding/Settlement dated 23rd September, 2025, which has been placed on record as Annexure-P-2 to the petition.

6. In terms of the settlement, the parties have resolved all their disputes and differences, and petitioner has paid a total sum of Rs. 20,00,000/- to the respondents no.2 to 4 towards full and final settlement of all claims.

7. The respondents no. 2 to 4 are present through video conferencing and have been identified by their counsel as well as by the Investigating Officer (‘IO’). They inform the Court that they have settled the matter of their own free will and without any coercion. They confirm that they have received the payment of the aforesaid amount from the petitioner and have no objection to the quashing of the present FIR.

8. The petitioner is also present through video conferencing and has been identified by his counsel. He affirms the statement of the respondents.

9. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would be an unnecessary burden on the State exchequer.

10. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

11. Even though the matter has been settled, the FIR was lodged in the year 2023 and the parties have settled the matter after 3 years. The petitioner, on account of his acts and omissions has wasted considerable time of the police and the courts in the present matter. In these circumstances, the petitioner would be liable to pay costs, which would be utilized for socially beneficial causes.

12. Consequently, FIR No. 789/2023 registered at P.S. Bindapur, and the proceedings pursuant thereto are quashed, subject to payment of costs of Rs. 15,000/- by the petitioner to the "Indigent & Disabled Lawyers Fund" of Bar Council of Delhi within two (2) weeks from today.

13. The necessary compliance report be filed with the Registry within four

(4) weeks from today.

14. The petition stands disposed of. AMIT BANSAL, J OCTOBER 13, 2026 Vivek/-
