% 13.10.2026 CRL.M.A. 32305/2026 (exemption)
1. Allowed, subject to all just exceptions.
2. The present petition has been filed seeking quashing of FIR No.614/2017 dated 27th December, 2017, for offences under Sections 498- A/406/34 of Indian Penal Code, 1860 registered at P.S. Vivek Vihar and all proceedings arising therefrom, on the basis of settlement.
3. Issue Notice.
4. Notice is accepted by the APP appearing on behalf of the State and the counsel appearing on behalf of respondent no.2.
5. Petitioner no.1 is the husband of respondent no.2 and petitioners no. 2 to 8 are the family members of petitioner no.1. The marriage of petitioner no.1 and respondent no.2 was solemnized on 21st April, 2016 as per Hindu rites and ceremonies. No child was born out of the wedlock.
6. Marital disputes arose between petitioner no.1 and respondent no.2, which resulted in filing of the present FIR on 27th December, 2017.
7. Now, the parties have settled their disputes in terms of the Settlement Agreement dated 27th November, 2025 executed before the Family Court-02, Shahdara District, Karkardooma Court, Delhi, which has been placed on record as Annexure A-4 to the petition. In terms of the settlement, petitioner no.1 agreed to pay total amount of Rs.4,00,000/- to respondent no.2 towards full and final settlement. Out of which respondent no.2 has received Rs.3,00,000/- as divorce has been granted to the parties. A demand draft of the remaining amount of Rs.1,00,000/- has been handed over by petitioner no.1 to respondent no.2 in Court today.
8. In terms of the settlement, the parties have resolved their disputes.
9. The respondent no.2 is present in Court and has been identified by her counsel as well as by the Investigating Officer (‘IO’). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the present FIR.
10. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties.
11. Considering the above settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present FIR and it would an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.
12. Consequently, the FIR No.614/2017 dated 27th December, 2017, registered at P.S. Vivek Vihar, and the proceedings pursuant thereto are quashed.
13. The petition stands disposed of. AMIT BANSAL, J OCTOBER 13, 2026 Vivek/-
