1. Contempt Petition under Sections 10, 11 and 12 read with Rule 5 of Contempt of Courts Act and Article 215 of the Constitution of India has been filed on behalf of the Petitioner against Respondent for willful disobedience of Order dated 06.03.2023 passed by this Court in CM(M) 339/2023 titled „Sandeep Lamba vs. Dimple Mahana & Ors.‟

2. Perusal of Order dated 06.03.2023 shows that learned counsel for the Petitioner (Respondent herein) had sought permission to withdraw CM(M) 339/2023; while permitting the withdrawal, it was noted that learned Executing Court should proceed in all earnest to execute the Decree, keeping in view the directions contained in Judgment passed by Hon‟ble Supreme Court passed in „Rahul S. Shah vs. Jinendra Kumar Gandhi‟, (2021) 6 SCC 418, directing the Executing Courts to execute all decrees within six months. The Petition was permitted to be withdrawn. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 15/10/2026 at 11:14:55

3. In view of aforesaid, only the Judgment passed in Rahul S. Shah (supra) was quoted, but no other directions were given by this Court in CM(M) 339/2023.

4. Mere grievance of the Petitioner / Decree Holder is that for the last six years, despite Execution proceedings being pending, Respondent / Judgment Debtor has been approaching this Court every now and then with some Application or other and is not executing the Decree, in favour of the Decree Holder.

5. From the submissions made, it is evident that the only grievance of the Petitioner is in respect of the Execution proceedings, which are being prolonged, for which, according to her, Judgment Debtor is responsible. There is nothing on record to show that there is any willful and deliberate contempt of any Order of this Court.

6. Insofar as the execution proceedings are concerned, Petitioner is at liberty to avail remedies in accordance with law.

7. There is no merit in the present Contempt Petition, which is hereby, disposed of along with pending Applications.
