1. By way of this petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 [“the Act”], the petitioner seeks appointment of an arbitrator, pursuant to the termination of the mandate of the learned Sole Arbitrator, who was in seisin of arbitral proceedings arising out of Contract bearing No. 90/Track-II/22/11/2 dated 12.11.1991 and Agreement No. 187-S/876/TSO/DNA dated 09.02.1995.
2. I am informed that the proceedings were last held on 09.01.2020, and the learned Arbitrator has since passed away.
3. Dr. B. Ramaswamy, learned Central Government Standing Counsel for the petitioner, seeks permission to withdraw this petition with liberty to file a petition under Sections 14 and 15 of the Act.
