1. Pursuant to order dated 07.10.2026, learned Counsel for the Respondent submits that he has received the instructions with respect to deciding the Indian Patent Application No.202117018485 (“Patent Application”) afresh after issuing a fresh hearing notice and granting hearing to the Appellant and also affording an opportunity to file Written Submissions post hearing.
2. In view of the same, it is directed that Patent Application filed by the Appellant shall be decided afresh by the Respondent within a period of three months by giving a fresh Notice of hearing followed by an opportunity of hearing to the Appellant and also granting time to the Appellant to file Written Submissions post hearing.
3. In view of the above, the order dated 02.01.2026 (“Impugned Order”) is quashed. It is further directed that the Patent Application shall be decided by another Controller than who has passed the Impugned Order. This is a digitally signed order.
