4. This is an application under section 482 of Code of Criminal Procedure and & section 528 of Bhartiya Nagarik Suraksha Sanhita, 2023 („BNSS‟) seeking stay of Non Bailable Warrants issued in Complaint Case No.1063/2024 titled as “Income Tax Office vs Anita Shokeen” and all proceedings arising therefrom, pending before the learned trial court, during the pendency of the present petition.

5. The contentions and deliberations have boiled down to the aspect that learned counsel for the petitioner is ready to extend the undertaking that the proceedings before the trial court would not be hampered in any manner on account of the petitioner, whereas he wants to confine the petition to “Prayer Clause-B” qua which learned counsel for the Respondent is ready to give a go-bye and does not want to contest the petition.

Therefore, taking into account the entire gamut of facts and circumstances, specially the assurance extended by learned counsel for the Petitioner, that they shall not create any impediment in the proceedings before the trial court, the petition is allowed, to the extent that the NBWs ordered to be issued against the

Petitioner stands recalled in terms of „Clause-B‟ of the prayer clause of the Petition. NBWs if not issued, be not issued and if issued, then the same be not executed, as that stand cancelled hereby.

7. Petition stands disposed-of accordingly.
