1. The present petition has been filed seeking quashing of FIR No.0065/2024 dated 23rd January, 2024, under Sections 498A/406/34 of the Indian Penal Code, 1860 (‘IPC’) registered at Police Station Tilak Nagar, Delhi and all proceedings arising therefrom, on the basis of settlement arrived at between the parties.

2. Issue notice.

3. Notice is accepted by the APP appearing on behalf of the State and the counsel appearing on behalf of the respondent no.2.

4. The petitioner no.1 is the husband of the respondent no.2 and petitioners no.2 to 4 are family members of the petitioner no.1. The marriage of the petitioner no.1 and the respondent no.2 was solemnized on 25th

August 2021 as per Sikh rites and ceremonies.

5. Marital disputes arose between the petitioner no.1 and the respondent no.2, which resulted in filing of the present FIR by the respondent no.2 against the petitioners.

6. Now, the parties have settled their disputes in terms of the Memorandum of Understanding (‘MoU’) dated 7th May, 2026, executed between the parties which has been filed as Annexure P-3 to the petition.

7. In terms of the MoU, the petitioner no.1 and the respondent no.2 have agreed to dissolve their marriage and obtain a decree of divorce. Further, a total sum of Rs. 19 lakhs was to be paid by the petitioner no.1 to the respondent no.2.

8. Out of the aforesaid amount, a sum of Rs.13 lakhs has already been paid to the respondent no.2 and the remaining amount of Rs.6 lakhs is being paid today by way of demand draft. In terms of decree of divorce dated 8th September, 2026, the parties have been granted divorce under Section 13 B

(2) of the Hindu Marriage Act, 1955.

9. The respondent no.2 is present in Court through video conferencing and has been identified by her counsel as well as by the Investigating Officer (IO). She informs the Court that she has settled the matter of her own free will and without any coercion. She further states that she has no objection to quashing of the FIR.

10. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of the respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties.

11. Considering the aforesaid settlement between the parties, no useful purpose would be served by continuing with the proceedings of the present

FIR and it would an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the present FIR and the proceedings pursuant thereto.

12. Consequently, the FIR No.0065/2024 registered at Police Station Tilak Nagar, Delhi and the proceedings pursuant thereto are quashed.

13. The petition along with pending application stands disposed of. AMIT BANSAL, J OCTOBER 12, 2026 Rzu
